算法价格歧视中消费者权益保护研究
摘 要:以大数据和人工智能等为代表的现代信息技术,已经成为产业转型
升级的重要驱动器,全球数字经济的发展势头愈加迅猛。大数据作为重要的生产
要素,催生了新的发展业态,进一步延伸产业链的同时也带来了新的挑战和风险。
在大数据背景下,价格歧视行为无疑是对消费者知情权、公平交易权、隐私权等
各方面的侵害,使市场竞争秩序受到破坏。这种价格歧视行为在网络购物中经常
出现,商家利用算法对消费者的特征差别定价,违背诚实信用原则。本文通过算
法价格歧视的内涵,分析消费者面临的区别对待及其危害,适时提出针对性的建
议保护消费者权益。消费者维权难方面,厘清消费者的知情权,帮助消费者收集
证据成功维权。监管难方面,确认有关部门的具体职责,创新监管方式,推进监
管手段顺利进行。拓宽消费者权益保护的救济渠道,完善举证制度,为消费者保
护增添力量。

Abstract : Modern information technologies such as big data and artificial
intelligence are leading the industrial transformation, and the wave of global digital
economy development has arrived. Big data has spawned new forms of development
and become a key factor of production for economic development. While big data
extends the industrial chain, it also brings new challenges and risks. Price
discrimination in the context of big data damages consumers' right to know, right to
fair trade, right to privacy, etc., and undermines market competition order.This kind of
price discrimination behavior often appears in online shopping, merchants use
algorithms to price consumers differently, violating the principle of honesty and credit.
Through the connotation of algorithmic price discrimination, this paper analyzes the
discrimination and harm faced by consumers, and timely puts forward targeted
suggestions to protect the rights and interests of consumers. In terms of consumer
rights protection difficulties, clarify consumers' right to know, and help consumers
collect evidence to successfully defend their rights. In terms of regulatory difficulties,
confirm the specific responsibilities of relevant departments, innovate regulatory
methods, and promote the smooth progress of regulatory means. Expand the relief
channels for the protection of consumer rights and interests, improve the system of
proof, and add strength to consumer protection.
